I purchased my RS2 at the dealership with 5 miles on the odometer but could not take it home due to the recall. 2 weeks later I pick it up and my odometer reads 83 miles on it. I have photos of me in the car minutes after leaving the dealership and if you zoom in on the odometer it reads 85 miles. Luckily I have a snapchat of me with the car at the dealership (date and time recorded), and the photos in the car with date and time recorded (theres no way 78 miles can be put on a car in the 6 minute difference between the two images). I have texts too between my sales agent and myself/ myself and my husband proving where the car was at certain times and where I was. I couldnt even drive the car yet and had to get my mom (who also has images with dates and times) to help me take it home because this is my first manual transmission. So my mom and sister were both with me when I picked it up and heard me call the sales agent out on my miles. He gave me some bs answer and I took it because I trust people too much but my odometer statement says otherwise.

Long story short what would be appropriate compensation to request from the dealership for this experience? I mean boil it down, the car was driven 78 miles without my permission while I owned it. Thats kind of auto theft and its a big deal.

Sadly he's right, perhaps just remind the dealership that this is unacceptable behavior for such an expensive and rare vehicle.

Would be nice to get something from them (Extended warranty would be my choice)....but in the end your only recourse is to fry them on the customer survey you get from Ford.

This will of course be awkward if you plan on getting service there.

Aside from that, a call to Ford Customer service is really the only other entity that could get involved. @FordService

Right now they don't even know I have images that prove my car was driven and they're working with me. I don't feel stonewalled yet, so I'm going to keep pressing. Its not acceptable for any dealership to act this way and i am not going to roll over and expect nothing for such **** treatment. I deserve compensation for this. I don't know what they've done with this car and 78 miles is a lo for a brand new car. I'm not giving up my power on this yet. I just was hoping for input on a reasonable request for them to make up for this ridiculous behavior. I understand I'm not going to receive the moon, but they should pay for what they've taken from me.

I would be livid as you for sure! There are certain repairs that would require a good # of surface miles to be put on a car during a testing; however, I find it difficult to believe that such a recall would warranty 78 miles!

That does not matter. They can cut you a check for what you paid for it. I'd push for that.

I wonder if there is a way to get Ford Service to pay for a full inspection at ANOTHER dealer to make sure nothing got hooned too badly. And of course, now they eliminated whatever option you had for how you wanted to break-in/seat your rings in the first 25 miles. You know they thrashed it. Just unbelievable jack*****. Also check tire wear to make sure they were not testing out Drift Mode for you.

Does anyone know if another dealership could pull data on what Modes/Speeds/Throttle the car was driven at during those interim miles?

What does your signed Odometer Disclosure Statement show? This is a federal document that both the seller and the buyer sign. When you purchase a car the mileage is disclosed to you, and both the owner and the dealer sign it. If the signed odometer disclosure statement shows less mileage than the car currently has then you have the absolutely right to demand an explanation for the mileage. When it was driven, where it was driven, and why it was driven.

My car had 11 miles on it when I first saw it, and 15 miles by the time I had my first test drive. My odometer disclosure statement reads 15 miles. I also have a signed statement of the car I was trading in as well.

If you signed any paperwork for add-ons like paint protection film and the like its possible the car was driven to a shop to have the work performed. In which case the dealer should have a log of the mileage.

The recall on the Focus RS was because of the rear hatch, no need to drive it.

This should be pretty simple. I'd show them the pictures and just ask them if there's a reason why the mileage statement was off by so much. If there's a legitimate reason not much can be done, but if they have no reason then they have potentially committed fraud. That said 78 miles isn't really a lot, but I'd be upset about it too. My biggest concern would be if they've cooked the tires.

If he doesn't have a signed odometer disclosure prior to buying the car they can tell the OP to pound sand.

Even getting a concession out of them after the ODO disclosure has been signed would be near impossible.

If all the paperwork was signed then unexplained mileage is definitely enough justification for a breach of contract and he could force a buy-back.

Once you sign those papers a dealer can't be driving your car willy nilly without an explanation. An owner would have to agree to services which might require driving the car somewhere.
